Limited 25-Year Residential Warranty
Abco Hardwood supplies quality prefinished flooring from Asia. All flooring products are manufactured in accordance with generally accepted rules and guidelines for prefinished hardwood flooring. All warranty coverage described below only applies to the original purchaser and is not transferable. This warranty applies to products purchased and installed after January 1, 2005.
Visual Appearance Guarantee
Each plank of flooring is carefully inspected prior to leaving the factory. We strongly urge you and your installer to inspect each plank prior to installation. If there is any doubt concerning the grade, finish, colour or overall quality of the material you have received please contact your dealer immediately. Do not install the flooring! This warranty does not extend to cover flooring after installation. Please refer to Abco’s Pre-Installation Warranty guide for further information. See Exclusions and Liability Limitations below.
Structural Guarantee
Abco warrantees all flooring products to be free of excessive structural defects for twenty five (25) years provided all installation and maintenance guidelines in accordance with Abco’s instructions as well as that of The National Hardwood Association (NWFA 1-800-848-8824) are followed. This structural warranty applies only under conditions of “normal residential use”. See Exclusions and Liability Limitations below.
Pre-Finish Guarantee
Abco warrantees all pre-finished flooring products to be free of excessive finish defects for ten years (10) years provided all installation and maintenance guidelines in accordance with Abco’s instructions as well as that of The National Hardwood Association are followed. See Exclusions and Liability Limitations below. Scratches, abrasions and dents to the finish regardless of cause are not a warranted item.
EXCLUSIONS
Abco warranties described above will not apply and Abco will not in any way be liable in the event of:
- Normal Variances: Wood is a natural and living product and variations in colour, grain pattern and/or texture normally occur in the original materials and are not defects and no warranty shall apply thereto. Product off-grading or defects up to 5% of the total shipment is acceptable according to industry guidelines. Installed flooring will change in colour over time and this is also a natural characteristic of wood products for which no warranty is provided. Minor gloss variations from that of the sample or between manufactured batch dates are acceptable.
- Improper Installation: Performance of the flooring is highly dependent upon proper installation. Accordingly, installation must be in accordance with the National Hardwood Flooring Association’s Rules and Guidelines on installing pre-finished hardwood flooring. A copy can be obtained from any Abco authorised dealer.
- Improper Maintenance: Maintenance must be in accordance with the instructions and recommendations found in Abco’s Floor Care Guide.
- Misuse: Abco will not assume responsibility for damage caused directly or indirectly by misuse, abuse, fraud, accident or use that is not consistent with NWFA Rules and Guidelines. Accordingly, no warranty, expressed or implied, is provided for any damage due to inadequate care or other causes, without limitation, stains, worn or narrow-heeled shoes, furniture or equipment movement, damage caused by heavy items, by impact, scratches or scarring caused by pets, abrasive, sharp or pointed items, extreme heat, damage from moisture caused by wet mopping, spills or standing water.
- Normal Environmental & Material Conditions: The relative humidity level should be maintained between 45% – 55% throughout the year. Our products are warranted to perform in what we consider to be normal residential applications. Any exposure to excessive heat, dryness, moisture or coldness may cause damage to the flooring, which is not covered by warranty regardless of cause or source. Shrinkage, expansion, cupping, crowning and material settlement are all inherent to hardwood flooring and thus are not warranted under any circumstance. Exotic hardwoods are naturally prone to splitting and cracking which is also not warranted under any circumstance.
- Alterations/Repairs: Alterations to any Abco product will void any and all expressed or implied warranties. No warranty is provided to cover repairs (unless and only to the extent performed under warranty by Abco) or resurfacing and repairs or replacement (even by Abco) shall not extend warranty period.
- Reinstallation: In the event that Abco is obligated, or elects, to replace or reinstall warranted planks, Abco shall in no manner be obligated to provide for or incur the costs of removing or reinstalling the defective flooring or resurfacing or refinishing the replaced or surrounding flooring or to provide for the cost thereof unless and to the extent expressly provided in the above warranty description. No obligation to replace or repair shall extend to any subfloor materials, adhesives, supplies or other items consumed in the course of removal, installation or refinishing.
CLAIM PROCEDURE
All claims must be made in writing to the authorized Abco Dealer where the purchase was made. Please note, however, that in order to make any claim under this warranty, evidence of the purchase date and the identity of the original purchaser and installation location must be provided and without such proof, no warranty coverage will apply. Any claim for warranty coverage must be made within 30 days from the date upon which the defect first became known.
LIABILITY LIMITATIONS
In no event shall Abco be liable or in any manner responsible for any claim, loss or damage arising from the purchase, the inability to use its products or from any form of special, indirect, incidental, or consequential damages. Including, without limitation, lost profits, emotional, loss of income, punitive or exemplary damages or attorneys fees, even if Abco or its representatives have been advised of the possibility of such damages before sale. Any costs associated with temporary relocation to another premise, is not the responsibility of Abco. In no event shall Abco be obligated to cover the costs of old or new materials other than Abco brand flooring products and any warranty thereto is limited to the warranty, if any, provided by the original manufacturer. In no event shall Abco liability exceed the amount Abco actually received upon distribution for the defective materials at issue.
This warranty gives you specific legal rights and you may have other rights that may vary from jurisdiction to jurisdiction. Some jurisdictions do not allow the exclusion or limitation of implied warranties or incidental, consequential, emotional distress or punitive damages, and in such event, the exclusions and limitations set forth above shall be deemed altered to the least extent possible to be enforceable. Accordingly, some of the above limitations may not apply to you. |
